PrestoMaths Terms & Conditions

1. Introduction

PrestoMaths is a web-based service operated by a sole trader trading as Presto Maths ("we", "us", "our"). By creating an account and using PrestoMaths, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the service.

These Terms apply to all users of PrestoMaths. If you subscribe to PrestoPlus, the Subscription Terms also apply to you.

2. The Service

PrestoMaths is a tool designed for use by maths teachers and maths education professionals. It is not intended for use by students or anyone under the age of 18.

You must be at least 18 years of age to create an account.
By registering, you confirm that you are engaged in maths teaching or maths education in a professional capacity.

3. Your Account

You must provide accurate and truthful information when registering.
You are responsible for maintaining the security of your account credentials and for all activity that takes place under your account.
You may only hold one account per person.
You must not share your account credentials with any other person.
We reserve the right to suspend or terminate your account if we reasonably believe these Terms have been breached.

4. Acceptable Use

You must not use PrestoMaths in any way that:

Breaks any applicable law or regulation.
Is fraudulent, harmful, or misleading.
Infringes the intellectual property rights of any third party (for example, reproducing copyrighted content from textbooks without authorisation).
Attempts to interfere with, disrupt, or damage the service or its underlying infrastructure.
Attempts to gain unauthorised access to any part of the service or another user's account.

5. Free Accounts

PrestoMaths offers a free account tier with limited access to features and storage. The limits applicable to free accounts are described on our website. We reserve the right to adjust the limits of the free tier at any time with reasonable notice to registered users.

6. Your Content

You are responsible for all content you create on PrestoMaths. We reserve the right to remove content that we believe violates these Terms or applicable law.

We do not use your content for any purpose beyond operating and providing the PrestoMaths service.

7. Intellectual Property

The PrestoMaths service, its branding, all associated software, and all question content, maths problems, and answers generated by PrestoMaths are the property of Presto Maths. You may not reproduce or redistribute any part of the service or its generated content except as expressly permitted under Section 8.

The activity structure you create — your selection, arrangement, and configuration of questions — is your own work. However, any downloaded resources incorporating PrestoMaths-generated content remain subject to the usage restrictions set out in Section 8.

8. Permitted Use of Downloaded Resources

Resources downloaded from PrestoMaths (including PDF worksheets and activity sheets) are licensed to you for personal, educational, and teaching purposes only.

You may:

Make unlimited physical copies of downloaded PDF resources for use with your own students.
Display resources, in their original unaltered form, for use by yourself and your own students (for example, on a projector, interactive whiteboard, or other electronic display).
Share resources digitally via secure, password-protected means (such as a Virtual Learning Environment) to enable access by your own students and their parents or carers only.
PrestoPlus for Schools subscribers only: Share downloaded resources with colleagues who hold an active PrestoPlus for Schools subscription on the same school account.

You may not:

Share resources with colleagues unless you hold a PrestoPlus for Schools subscription (see above).
Upload resources to websites, shared drives, or other services in a way that enables access by anyone other than your own students and their parents or carers (or, for PrestoPlus for Schools subscribers, colleagues with an active school subscription on the same account).
Republish, redistribute, or sell any part of a downloaded resource in any form.
Alter, modify, or remove any copyright notices or PrestoMaths branding from downloaded resources.

9. Availability

We aim to keep PrestoMaths available at all times but cannot guarantee uninterrupted access. We may occasionally take the service offline for maintenance and will endeavour to provide advance notice of planned downtime where possible.

10. Limitation of Liability

PrestoMaths is provided "as is" without warranty of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Our total aggregate liability to you for any claim arising out of or in connection with these Terms shall not exceed the total fees paid by you to PrestoMaths in the 12 months preceding the claim. For free account users, our total aggregate liability shall not exceed £100.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of any significant changes by email at least 30 days before they take effect. Continued use of the service after changes take effect constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
